GENERAL CONDITIONS FOR DISTANCE SELLING JUCHEPIE & FRIENDS
The customer must always read the general terms and conditions of distance selling before placing an order. The placing of an order on the website or by e-mail constitutes the explicit acceptance of the general conditions of distance selling.

2. GENERALITIES AND DEFINITIONS
These general conditions apply to distance sales (via the website www.juchepieandfriends.eu) by Juchepie & Friends and this on the territory of Belgium. All other conditions are excluded. Juchepie & Friends may amend these general conditions at any time. Current contracts are always subject to the conditions which were applicable at the time of the conclusion of the sale. Ordering via the website is only possible if the delivery address is located in Belgium. Enquiries can be made via e-mail to info@juchepieandfriends.eu or sales@juchepieandfriends.eu as to whether delivery abroad is possible. The agreement will be concluded in Dutch. Further data exchange will also take place in Dutch. The customer cannot invoke the fact that he does not have a sufficient command of Dutch to invoke the inapplicability of one or more conditions.
To order a product online, the customer must add it to his shopping cart. He then enters his customer details and chooses the payment method. Finally, to finalise the reservation or order, the customer must press the button labelled “pay” and make the payment. It is not enough to place an order on our website to make a sale. Only upon receiving the confirmation e-mail is the sale concluded. Juchepie & Friends reserves the right to request additional information for the safety and security of the customer and, failing this, to refuse the execution of the order. Orders which show that the customer intends to resell the products himself, orders by minors, large orders or incomplete orders may also be refused by Juchepie & Friends. The same applies if in the description of the product or the price indication on the website, despite the great care taken by Juchepie & Friends to ensure the accuracy of the data, a manifest error is made.
Availability is indicated with each product. Juchepie & Friends makes every effort to indicate this data correctly. Nevertheless, it may happen that delivery is not possible, e.g. due to inadvertent errors in stock data or products which are not available from the supplier. In these cases the order will be refused. Juchepie & Friends will inform the customer as soon as possible and propose a solution. In the event of force majeure, Juchepie & Friends can suspend its obligations for the duration of the force majeure or definitively dissolve the agreement.
4. TRANSFER OF OWNERSHIP
The goods remain the exclusive property of Juchepie & Friends until the sending of the confirmation e-mail that the sale has been concluded. The risk of loss or damage is transferred to the customer as soon as he takes possession of the goods.
5. PRICES
The prices include VAT and excise duties. Shipping costs are not included; these are stated separately. All offers are valid as long as they are listed on the website and as long as stocks last. The prices indicated may change at any time. If an order is placed, the price applicable to this distance selling shall be the price applicable at the time of ordering.
6. PAYMENT
Payment is made exclusively via the online payment methods proposed by Juchepie & Friends. To ensure safe online payment and the security of your personal data, the transaction data are sent over the Internet in encrypted form using SSL technology. To pay with SSL, the customer does not need any special software. In case of non-timely payment, the order will be refused.
7. DELIVERY
All goods are delivered to the address indicated by the customer. For the customer’s safety and security, proof of identity (or a copy) may be requested upon delivery. The customer signs for receipt of the delivery. Delivery is made by courier service (for contact details see www.DPD.be) or by Juchepie & Friends’ own transport.
Any complaint regarding visible damage to delivered goods or damage caused by our deliverers, as well as any complaint regarding an incorrect or incomplete delivery must, in order to be taken into account, be reported within 24 hours of delivery by e-mail to info@juchepieandfriends.eu.
Shipping costs in Belgium:
From €175 = free delivery.
Below €175 = shipping costs:
– per package (up to 12 bottles) – 12,5€
Shipping costs in the Netherlands, Germany or Luxembourg:
– per colli (up to 12 bottles) – 17,5 €
8. DELIVERY TIME
The delivery periods stated by Juchepie & Friends are indicative and not enforceable. If a product is ordered that is temporarily out of stock, it will be indicated when the product will be available again. Juchepie & Friends shall not be liable for any consequential damages due to late delivery or non-delivery by the appointed carrier. In such cases, liability is limited to the value of the goods proven by the customer not to have been received.
9. CORQUE WARRANTY
If the wine has cork taste, the bottle in question may be returned to Juchepie & Friends as full as possible, with the original cork. If the Juchepie & Friends sommeliers recognise the cork taste, the wine bottle will be exchanged for the same bottle currently on sale; among other things, the vintage may therefore change. Under no circumstances will the wine bottle be refunded by Juchepie & Friends. This service is valid only on presentation of a valid proof of purchase (receipt, ticket or invoice) and for a maximum of 1 year after purchase of the wine.
This provision applies exclusively to distance sales to consumers. This provision therefore does not apply to purchases made within a trade, business, craft or profession, nor to purchases made by legal entities.
The contract may be revoked without giving reasons within 14 days from delivery. This period starts the day after the goods have been received by or on behalf of the customer. The customer may exercise its right of withdrawal by emailing a statement to this effect to info@juchepieandfriends.eu within this period.
During the withdrawal period, the consumer will treat the delivered goods and their packaging with care. The consumer shall only unpack or use the goods to the extent necessary to assess whether the consumer wishes to keep the goods. If the goods are no longer in their original and undamaged condition, the consumer may not invoke his right of withdrawal. If the packaging is part of the goods (e.g. a wine box or special box), it should also be in its original and undamaged condition. The consumer shall be liable for any diminished value of the goods resulting from the use of the goods beyond what is necessary to establish the nature and characteristics of the goods.
Without delay and in any event within 14 days of the day on which the consumer communicated his decision to terminate the contract to Juchepie & Friends, the consumer shall return the goods in one of the following ways:
– The consumer returns the goods by post; at his expense.
– The consumer returns the goods to the address below ;

If the consumer revokes the agreement, Juchepie & Friends will refund the full purchase price and this with the same means of payment with which the consumer made the original transaction, unless the consumer has agreed otherwise. Transport costs are not part of the purchase price and therefore remain at the consumer’s expense. Payment shall be made without delay and at the latest within 14 days of the goods being returned.

These remote sales conditions are valid from 01.01.2023.
